You approve a reformulation, the packaging is printed and the launch date is set. Then a regulatory update lands and one ingredient sits under two different sets of rules, depending on which side of the Channel your customer lives.

That is the position many brands now face with silver. I have spent 25 years as a formulation and regulatory manager, and few ingredients have moved this quickly in such a short time.

# Why Silver Has Become a Headache for Cosmetic Brands

Silver appears in oral care, colour cosmetics and antimicrobial claims. In October 2024, micron-sized silver was classified under CLP as a reproductive toxicant. That triggered tight restrictions in the EU cosmetics framework, and many formulators had to review their products in a hurry.

Two regulators have since revisited the science, and they have reached different conclusions. The result is a new regulatory divergence that SME owners, technical directors and formulators need to understand before they plan their next launch.

## Silver in the EU: From Restriction to a Proposed Reopening

### What applies today

Commission Regulation (EU) 2026/78, often called Omnibus VIII, has applied since 1 May 2026. It prohibits silver nano and silver massive. For micron-sized silver powder, it allows only a narrow set of uses: toothpaste and mouthwash up to 0.05%, and lip products and eyeshadows as a colourant (CI 77820) up to 0.2%.

### What is proposed

In 2025, industry submitted new dermal penetration studies. The SCCS reviewed them and, in its opinion SCCS/1687/25 of 24 April 2026, concluded that micron-sized silver does not penetrate the skin. It judged silver safe at up to 0.2% in rinse-off products and 0.3% in leave-on products, excluding uses that could lead to inhalation, such as sprays.

The Commission notified a draft amendment to the WTO on 30 July 2026. Comments closed on 28 September 2026, and adoption is expected in the final quarter of the year, with application proposed from 1 May 2026. This remains a draft and is not yet law. Plan around it, but do not treat it as settled.

### Silver in Great Britain: A Different Set of Limits

On 21 August 2026, the Scientific Advisory Group on Chemical Safety (SAG-CS) published Opinion 26 on silver. Its conclusions for micron-sized particulate silver are:

- 0.3% in leave-on products, excluding lip products
- 0.2% in lip products
- 0.3% in rinse-off products, excluding mouthwashes and toothpastes
- 0.05% in mouthwashes and toothpastes, for all age groups

SAG-CS did not assess nail products or propellant sprays. It also makes no distinction between children's and adults' products. An opinion informs future legislation, so check the legal position before relying on it for a launch.

### A Mini Case Study

Picture a UK start-up with a silver-containing body wash and a leave-on foot cream, planning to export to Germany. Under the SAG-CS limits, the wash could carry 0.3% silver. The EU draft caps rinse-off products at 0.2%, so the same formula could not simply cross the border.

A modest reformulation would solve it, and an early check would have caught it. Without that check, the brand could have faced relabelling and delayed shipments after the packaging was already printed.

## Five Practical Steps for Brands and Formulators

1. **Map your silver.** List every product containing silver, its form (nano, micron-sized or colourant), its concentration and its product type.
2. **Confirm particle size with suppliers.** The rules depend on particle diameter. Ask for up-to-date specifications and supplier statements, and do not rely on old documents.
3. **Design for both markets.** If you sell in both, formulate to the stricter limit for each product category. This often removes the need for separate versions.
4. **Review your safety assessment.** Your Cosmetic Product Safety Report and your EU and UK notifications must reflect the actual concentration and use.
5. **Monitor adoption dates.** Watch the Commission's final adoption of the EU amendment and the GB legislative follow-up to Opinion 26. Build review points into your launch calendar.

## What that means for you

Silver shows how fast cosmetic regulation can move, and how far the EU and GB frameworks are drifting apart. For SMEs, that divergence creates risk, but it also creates opportunity. Brands that understand both sets of rules can reformulate with confidence, keep ingredients that others drop and enter two markets without nasty surprises.
